First DUI. If you are facing your first DUI, you have to remember that, no matter how you choose to take care of your DUI—by entering DUI “Diversion,” by pleading guilty, or by taking your case to trial—you still may risk the following maximum penalties:

  • 1 year jail
  • $6,250 court fines
  • 5 years probation
  • Criminal conviction
  • 1-year driver’s license suspension

Taking care of your DUI in “Diversion”—a program than can last up to 18 months, and allow you to avoid many of the maximum penalties at the beginning—may be a great option for you. However, if you fail the program at any time, then you still face all of the original penalties, and people get burned by this every day.

Repeat DUI. If you are facing your second, or third, or even fourth DUI, then you have a big, red bullseye on your back. Already paid your dues for the past? Police and prosecutors can and do rush to judgment if you are arrested on another DUI. While a first-time DUI driver may be able to get off with a slap on the wrist, you are going to be targeted just like a hardened criminal.
