“The Best DUI Defense is Knowing the Offense” - Sunil K. Raju, Former Prosecutor

First-Time DUI

If you have been arrested for your first DUI in Oregon, then you are likely facing a lot of “firsts”:

  • Your first arrest;
  • Your first night in jail;
  • Your first driver’s license suspension;
  • Your first criminal charge (DUI is a crime);
  • Your first court date.

If you are overwhelmed, then take a deep breath and know that you are not alone. Each year, over 7,000 drivers are arrested for DUI in the greater Portland area, many for the first time.

People arrested for DUI range from the clerk at the grocery store, to the soccer mom, to the CEO, and all sorts of other people.

There are important timelines you need to keep in mind, to make sure you do not miss anything, including:

  • 10 days: You only have 10 days from your arrest to request a DMV hearing;
  • 30 days: You only have 30 days from arraignment to decide if you should enter the DUI “Diversion” program, if you have the option;
  • Before arraignment: Your lawyer can contact the DA’s office beforehand and may be able to learn what charges you are facing.

Oregon's DUI “Diversion” program is generally an option for first-time DUI drivers. Diversion is a program lasting 12 months (up to 18 months with an extension), during which you still have all of the risks of a criminal conviction if you make any mistakes.
